Welcome to Pimalu. These Terms of Service ("Terms") govern your use of our website and any purchase you make from us. By accessing our website or placing an order, you agree to these Terms. If you do not agree, please do not use our website. 

Throughout these Terms, "Pimalu," "we," "us," and "our" refer to Pimalu, and "you" refers to anyone who visits our website or makes a purchase. 

Eligibility and accounts 

You must be at least 18 years old, or the age of majority where you live, to make a purchase on our website. If you create an account, you are responsible for keeping your login information secure and for all activity under your account. Please provide accurate, current information and let us know right away if you believe your account has been used without your permission. 

Products, pricing, and orders 

Product information. We do our best to display our products, colors, and sizing accurately, but colors may look different depending on your screen, and slight variations in fabric and finish can occur. Please check our size guides and product descriptions before ordering. 

Pricing. All prices are in U.S. dollars and may change at any time without notice. If a product is listed at an incorrect price because of an error, we may cancel any orders placed at that price and refund you in full. 

Orders. Your order is an offer to buy, and it is accepted when we ship it. We may limit quantities or refuse or cancel any order, for example if an item is out of stock, we suspect fraud, or there is an error in the listing. If we cancel an order after you've been charged, we'll refund you in full. 

Payment. Payment is due when you place your order. By submitting payment, you confirm that you are authorized to use the payment method you provide. 

Shipping, returns, and privacy

Product care and safe use 

The safety of your little one matters to us. Please follow the care instructions on each product's label, and inspect clothing and bedding regularly for loose threads, buttons, snaps, or other wear. Stop using any item that is damaged. 

Use crib and bassinet sheets only on a mattress of the size they are designed for, so the sheet fits snugly. Always follow current safe sleep guidance from your pediatrician or the American Academy of Pediatrics. Pimalu is not responsible for injury or damage resulting from misuse of our products or failure to follow care and safety instructions. 

Intellectual property 

All content on our website, including text, photos, graphics, logos, product designs, and the Pimalu name, is owned by or licensed to Pimalu and protected by copyright and trademark laws. You may not copy, reproduce, or use our content for commercial purposes without our written permission. 

Reviews and feedback 

If you submit a review, photo, comment, or other content, you give Pimalu a non-exclusive, royalty-free right to use, display, and share it in connection with our business, including on our website and social media. You confirm that your content is your own and is not false, offensive, or unlawful. We may remove any content at our discretion. 

Prohibited uses 

You agree not to use our website to break any law, interfere with the site's security or operation, upload viruses or harmful code, collect other users' information, or buy products for unauthorized resale. We may suspend or end your access if you violate these Terms. 

Disclaimers 

Our website and products are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that our website will be uninterrupted, error-free, or free of viruses. 

Limitation of liability 

To the fullest extent permitted by law, Pimalu will not be liable for any indirect, incidental, special, or consequential damages arising from your use of our website or products. Our total liability for any claim related to a purchase will not exceed the amount you paid for that order. Some states do not allow certain limitations, so some of these may not apply to you. 

Indemnification 

You agree to defend and hold harmless Pimalu and its owners and employees from any claims, losses, or expenses (including reasonable attorneys' fees) arising from your violation of these Terms or misuse of our website or products. 

Governing law 

These Terms are governed by the laws of the State of New Jersey, without regard to its conflict of law rules. Any dispute arising from these Terms or your use of our website will be handled in the state or federal courts located in New Jersey.
